2d) Diaper wipes in a plastic bag and diapers in plastic bag were within reach of children in bathroom accessible to children (plastic bags were removed at time of visit) 3f) Floor lamp is not secured to wall in Husky Room and poses a tipping hazard. (Floor lamp was secured to wall at time of visit) Dispute Description: Bezos Academy respectfully disputes the Non-Compliance citing WAC 110-300-0165(2)(d). Bezos Academy’s top priority is protecting the health and safety of children in its care. The Department cited Bezos Academy with a serious concern because plastic bags were allegedly accessible to children. However, the bags referenced in the Observation section of the Inspection Report were pull-up diapers in their plastic sleeve. Further, the package of pull-up diapers was on top of the extra clothing cubbies inside the restroom. Bezos Academy’s students do not have unsupervised access to this part of the restroom. Given that students do not have unsupervised access to these materials, and the fact that the referenced material was a sleeve filled with pull-ups and therefore was not a loose or empty plastic bag, Bezos Academy did not make plastic bags accessible to children. As such, Bezos Academy was operating in compliance with WAC 110-300-0165(2)(d) and respectfully requests removal of this Non-Compliance. Although we understand we cannot dispute Technical Assistance provided, we also respectfully request that the reference to WAC 110-300-0165(3)(f) be removed from the Observation notes in the Non-Compliance section. As the form currently reads, this reference gives the impression that the floor lamp presented a serious concern.
